We do not offer investment advice or personalized financial guidance. No material presented on our platform should be interpreted as a recommendation to buy, sell, or hold any security or financial product.

Disclaimer — Technical and Market Data

The Platform includes access to technical indicators, signals, charts, valuation metrics, and financial visualizations (collectively, the “Market Tools”). These are educational tools only and not intended for live trading or decision-making.

Fusion Point Capital LLC makes no representations or warranties regarding the accuracy, completeness, timeliness, or reliability of any Market Tools.

These tools are built on public and third-party data sources, which may contain errors, omissions, or delays. Our software may surface signals based on mathematical conditions (e.g., moving averages, slopes, standard deviations), but such outputs do not predict future price action.

We expressly disclaim any liability for losses or damages arising from use of these tools, including but not limited to technical trading signals, regression models, valuation rankings, or visual analyses.

You assume full responsibility for verifying any data or outcome presented within the Platform.

Subscription Access, Billing, and Cancellation

Our software requires a paid subscription to access most features. Billing is handled by Stripe; by subscribing you agree to their consumer terms. By subscribing through our service:

• You agree to recurring billing at the interval shown at checkout until canceled.
• You may cancel at any time from the Account → Billing screen, or by emailing support. Cancellation takes effect at the end of the current billing period — you retain access until then.
• All payments are final and non-refundable, including partial months, except where a refund is required by applicable consumer-protection law.
• We reserve the right to change pricing or features with at least 14 days' notice.
• If a payment fails Stripe will retry on a standard schedule; if all retries fail your subscription is paused and feature access is suspended until a successful charge.

Free Trials

We may from time to time offer a free trial (e.g. a 14-day evaluation). Trials require a payment method on file and will automatically convertto a paid subscription at the trial's end unless canceled before that date. Only one trial per person.

Beta Features

We sometimes label parts of the Platform as “Beta”, “Preview”, or “Experimental”. These features are provided as-is and may change or be removed without notice. Beta features are excluded from any uptime or accuracy commitment and should not be relied on for critical decisions.

Permitted Use and Restrictions

You may use this site for personal, non-commercial purposes only. You may not:

• Frame, scrape, copy, or republish our content
• Reproduce or redistribute technical charts, analytics, or code
• Share your login with others or bypass access restrictions
• Use the Platform to train, fine-tune, or benchmark a machine-learning model without our prior written consent

Proprietary Information

All content, software, and data visualizations are the property of Fusion Point Capital LLC or its licensors. No intellectual property rights are transferred to you by accessing the site. You may print content solely for personal use and must retain all copyright notices.

Third-Party Links

This site may link to external websites. We are not responsible for the accuracy, availability, or content of third-party resources and disclaim any affiliation unless explicitly stated.

Limitation of Liability

To the maximum extent permitted by law:

Fusion Point Capital LLC and its affiliates shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages of any kind — including but not limited to financial loss, lost profits, or lost data — even if advised of the possibility of such damages.

In any case, our total liability shall not exceed the greater of $100 or the amount paid by you in the prior 12-month period for access to the Platform.

Indemnification

You agree to indemnify and hold harmless Fusion Point Capital LLC, its employees, officers, contractors, and affiliates from any claims, liabilities, or damages arising out of your use of the Platform, breach of these Terms, or violation of applicable laws.

Security

You are responsible for securing your login credentials. Authentication is delegated to our identity providers (Auth0 / Google / GitHub via NextAuth); please enable two-factor authentication on whichever provider you use. Unauthorized access, scraping, or probing of our systems is prohibited. We reserve the right to suspend or terminate access at our discretion.

Governing Law

These Terms shall be governed by the laws of the State of Nevada. You consent to exclusive jurisdiction in Clark County, Nevada for any disputes arising out of your use of the Platform.

Modifications

We may update these Terms at any time. The “Last Updated” date above reflects the most recent change. Continued use of the Platform after changes are posted constitutes your acceptance of those changes.
